Volunteer release and waiver of liability
This Release and Waiver of Liability form, submitted by me, us, the volunteers, for the escarpment cleanup event commencing on the 23th day of April, 2022, releases Escarpment Project Inc., Gregory Lenko, the project co-ordinator, and his agents or assigns. The volunteers desire to provide volunteer services for the coordinator and engage in activities as part of the team in the cleanup of Albion Falls, Billy Green Falls, Bruce Trail and side trails, Chedoke Stairs, Radial Trail & Falls area, James Street Stairs area, Devil’s Punchbowl area, Felker’s Falls and Davis Creek area, Kenilworth Stairs & Rail Trail area, Red Hill Valley area, Wentworth Stairs and surrounding areas in Hamilton as well as 40 Mile Creek Trail and area in Grimsby.
I understand that the scope of the relationship between myself, Whomever I am in attendance with and with the project coordinator is limited to a volunteer position and that no compensation is expected in return for services provided by the Volunteers; that the project coordinator will not provide any benefits traditionally associated with employment to Volunteers and that the Volunteers are responsible by their own insurance coverage in the event of personal injury or illness as a result of this activity.
- Waiver and Release : I, We, the Volunteers, release and forever discharge and hold harmless the project coordinator from any and all liability, claims and demands of whatever kind or nature which arise or may hereafter arise from the services we provide during this cleanup. This shall include claims with respect to bodily injury, personal injury, illness, death or property damage that may result from the services we provide or occur while we are providing the volunteer services.
- Insurance: We further understand that the project coordinator does not assume any responsibility for, or obligation to provide us with financial or other assistance including medical, health or disability benefits or insurance of any kind in the event of our injury, illness, death or damage to our property, beyond that what which may be freely offered by the project co-ordinator.
- Medical Treatment: We further release and forever discharge the project coordinator from any claim whatsoever which may arise on account of any first aid treatment or other medical services rendered to us in connection with an emergency during our tenure as volunteers with this project.
- Photographic Release: We further grant and convey to the project coordinator all right, title and interests in any and all photographs, images, video or audio recordings of us made in connection with this project.
